Transsexual accuses woman of sexual violation

16 March 2004

An unusual court case, of a transsexual bringing a private prosecution
against a woman alleged to have committed sexual violation, has been set
down for a hearing.

The case was called in Wellington District Court yesterday and the alleged
victim, who is also the prosecutor, agreed to a remand until April 26.

Because the law prevents the publication of the name of a victim or alleged
victim of a sexual crime, the name of the prosecutor cannot be used.

Judge Bruce Davidson also suppressed the name of the alleged offender.

He allowed the application of defence lawyer Mark Lillico to have the court
record reflect that his client is female and not a transgender as stated on
documents charging her with the offence.
